Pre-Trial Update in Dr. Amann vs. C.M. Punk & Colt Cabana suit, including next two key dates

June 21 Update: The latest case management conference was held on Tuesday before the next big step in WWE doctor Chris Amann’s lawsuit against C.M. Punk and Colt Cabana.

On Monday (June 27), the case will advance to the pre-trial stage in Cook County, Ill. (Chicago). The official legal label is “trial setting call.”

The court system is undergoing a transition phase of assigning cases for trial. The hearing at 9:30 a.m. on June 27 presided by Judge Marcia Maras will determine when the actual trial takes place.

There is also a new court date at the Circuit Court level. Judge Janet Brosnahan, who has presided over the case since the beginning, has set a “focused case management date” of August 23 at 9:15 a.m.

Dr. Amann is suing Punk and Cabana for defamation related to Punk’s infamous Thanksgiving 2014 podcast interview with Cabana accusing WWE and Dr. Amann of being negligent with his health leading up to his exit from WWE in January 2014.

MAY UPDATE: The case of WWE doctor Chris Amann vs. C.M. Punk and Colt Cabana was back in court on Tuesday (May 3).

The pre-trial is still scheduled for June 27. However, already on the schedule was a case management conference on Tuesday. Included in this week’s proceedings was Judge Janet Brosnahan allowing Dr. Amann to submit a deposition.

Judge Brosnahan also scheduled another case management conference on June 21, one week before the pre-trial procedure.

APRIL UPDATE: A pre-trial date has been set in WWE physical Chris Amann’s lawsuit against C.M. Punk and Colt Cabana.

On Monday (April 4), the Circuit Court of Cook County initiated the trial process for Monday, June 27, 2016 at 9:30 a.m.

The presiding judge assigning the trial date will be Marcia Maras. According to a separate court document effective April 1, the circuit court is going through a transition period of assigning cases.

Amann vs. Punk & Cabana was assigned to Judge Maras in Court Room 2006 in Chicago as part of falling within the transition period window of May 1 to July 31.

MARCH UPDATE: The latest court hearing in the case of Dr. Chris Amann vs. C.M. Punk & Colt Cabana was held on Friday, March 18.

The result was the same as in February – advancing to the next court date, which is now set for May 3 to review the latest information in the discovery process.

The conference on March 18 included an “exchange of information” between Dr. Amann and Punk’s legal teams as part of the normal progression of the case.

Judge Janet Brosnahan has scheduled another case management conference on May 3 after six more weeks of discovery.

FEBRUARY UPDATE: The latest court hearing in the case of Dr. Chris Amann vs. C.M. Punk & Colt Cabana was held Monday in Cook County (Chicago), Illinois Circuit court.

– The case was continued until March 18 for the next hearing to discuss the latest evidence. Specifically noted for the next conference is an “exchange of information” requested by Dr. Amann.

– The case was re-assigned to Cook County’s “Category 2,” which means the back-and-forth “discovery” process submitting evidence needs to be completed within 28 months. This means the case has potential to roll into 2017 if there is not a settlement.

– Representatives for Dr. Amann, Punk, and Cabana all submitted “agreed orders” to Judge Brosnahan during Monday’s hearing. This may have been a written agreement to resolve an aspect of the case.

DEC. 17 UPDATE: There is new activity in the case of WWE physician Chris Amann vs. C.M. Punk and Colt Cabana.

Both Punk and Cabana filed documents dated December 15 responding to Dr. Amann’s civil complaint of libel and slander stemming from their November 2014 podcast discussing Punk’s WWE exit.

According to the latest court records, Punk and Cabana filed an “Answer to the Complaint Filed” and an “Affirmative Defense.” It’s unclear on what grounds Punk and Cabana filed the Affirmative Defense, which broadly means that both are attempting to use some form of legal grounds to seek a dismissal of Dr. Amann’s claim and/or justify their actions that would satisfy the claim.

The documents were filed this week to follow up on the previous hearing in Cook County (Illinois) Circuit Court on November 24. The case has been continued to February 1, 2016.

NOV. 26 UPDATE: The ongoing legal battle between WWE doctor Chris Amann and C.M. Punk & Colt Cabana will spill into 2016, according to updated court records in Cook County (Chicago), Illinois.

A hearing was scheduled for Tuesday to determine whether the case should continue based on the validity of Dr. Amann’s allegations.

Court records show that presiding judge Janet Brosnahan continued the case to February 1, 2016. The records also show that Judge Brosnahan allowed and denied requests presented by Dr. Amann. No specifics were included.

It has been one year since Punk broke his silence on Cabana’s podcast on Thanksgiving 2014 that included strong criticism of WWE’s medical team. This led to Dr. Amann’s lawsuit against Punk & Cabana.

NOV. 16 UPDATE: The latest from WWE Dr. Chris Amann’s suit against C.M. Punk & Colt Cabana is the allowance of a protective order.

According to court records, Judge Brosnahan allowed a protective order to be enacted at a court hearing on Monday. This will apparently prevent all parties from publicly discussing the case or disclosing information.

The next court date is November 24. The presiding judge is scheduled to review Dr. Amann’s libel/slander allegations after a period of time for both sides to submit new information.

NOV. 10 UPDATE: A new hearing has been scheduled in the case of WWE ringside doctor Chris Amann against C.M. Punk & Colt Cabana.

After Dr. Amann filed a series of exhibits with the Circuit Court of Cook County (Chicago, Ill.), a motion hearing was scheduled for next Monday, November 16 at 10:00 a.m.

This follows Dr. Amann having a deadline of last Tuesday, Nov. 3 to file additional information in response to Punk’s latest filing on Oct. 19.

SEPT. 22 REPORT

Another court hearing is set for later this year in the ongoing legal battle between WWE physician Chris Amann and C.M. Punk & Colt Cabana.

According to court records from the Circuit Court of Cook County (Ill.), the next hearing is set for November 24 at 2:30 p.m. The date is almost exactly one year after Punk broke his silence on Cabana’s podcast discussing his WWE departure, which led to Dr. Amann suing Punk and Cabana.

At Monday’s court hearing, circuit judge Janet Brosnahan set additional dates for more amendments or additional information to be submitted in the case.

Punk has until October 19 to submit new information or amend an existing claim in response to Dr. Amann’s lawsuit.

Dr. Amann then has until November 3 to submit new information or respond to Punk’s latest filing.

Judge Brosnahan will then review both sides’s legal position three weeks later after continuing the case on Monday. It is possible a ruling will be made on Nov. 24.
