TNA News: Clarifications and in-depth details on the charges and legal situation Kurt Angle is facing after Saturday's arrest

Torch reader Creighton Rabs of Westchester Unplugged sent the following report on the legal issues involved in Kurt Angle's arrest on Saturday morning.

I have covered court cases in Chester County, Pa. (outside Philadelphia) fairly regularly for the past couple of years. There appear to be some inaccurate facts regarding upcoming future proceedings against TNA's Kurt Angle, particularly with respect to some of the AP's reporting.

For starters, despite some of the rumors posted on other sites, there's a good chance that Kurt Angle's attorney is correct about his client's DUI status, in which he claimed that Angle's license was not suspended.

According to an on-line records search of the Pennsylvania Unified Judicial System's court case portal (http://ujsportal.pacourts.us), Angle was arrested on September 28, 2007 by Moon Township Police on charges of DUI and Careless Driving. After a non-jury trial in the Allegheny County Court of Common Pleas, Angle was found not guilty of DUI and Careless Driving.

Unless he was either (a) subsequently arrested and convicted of a DUI offense in another state or (b) there was a Pennsylvania Dept. of Transportation (PennDOT) ordered suspension due to refusal to submit to chemical testing or other reasons, then Angle's license should not have been suspended due to DUI.

This is pretty significant, since in Pennsylvania, Driving Under DUI Related Suspension carries a mandatory minimum sentence of 60 days in county jail - a Driving Under Suspension/Non-DUI Related carries only a fine.

In the Robinson Twp case, Angle is charged with two misdemeanor drug possession counts under a summary offense (in some states, they're called "violations" or "infractions" - similar to a traffic ticket) of Harassment. That's the case that's scheduled where his preliminary hearing (probable cause) hearing is scheduled for September 15.

The ten percent bail is not unusual in Pennsylvania; in most counties, it's standard to allow defendants to post ten percent directly to the court to secure a defendant's release.

In addition to that case, police in Moon Township charged Angle with Simple Assault (2nd degree misdemeanor) and Harassment (summary). A summons was issued on Monday with a preliminary hearing scheduled for October 6. Under Pennsylvania's Rules of Criminal Procedure, police generally issue a summons for ungraded, 3rd and 2nd degree misdemeanors.

There was in fact a second arraignment on the PFA Violation that was filed by Robinson Township police. Allegheny County arraignments outside of normal court hours are filed under a separate district court - the "Allegheny County Night Court. That's where all arraignments outside of normal court hours in the county are processed. Bail in both cases was in fact set at 10 percent of $10,000.
