WWE will have a difficult time bumping the NBA's Denver Nuggets out of their own arena next Monday night, but in all likelihood, WWE should be compensated fairly well for the Pepsi Center double-booking the arena and bumping WWE out.

The Denver Post quoted a local contract lawyer who specializes in sports legal issues who said both sides will need to sit down and work out a financial arrangement to compensate WWE for lost revenue.

"If the contract doesn't provide them with an out, they're going to have to sit down and work something out," said Brian Gaffney, a Denver lawyer.

WWE claims there was not a provision in the arena contract stating WWE could be bumped in favor of another event. WWE would be seeking compensation for the Nuggets breaking the terms of the contract.

Sports business columnist Darren Rovell of CNBC.com sides with WWE in the legal matter. Rovell says the Nuggets should have included a clause in the contract protecting the arena if another date, such as the NBA Playoffs, were to come up.

"It's common sense that the Denver Nuggets should be able to play in their own arena for a playoff game on the date and time that the NBA sets," Rovell said. "Unfortunately, in the case of the Nuggets spat with the WWE, it doesn’t make much legal sense."

Rovell says WWE turning this into a publicity-generator shouldn't over-ride the issue that attorneys for the Nuggets and the Pepsi Center should have included a clause in the contract. Their over-sight could mean a future pay-out to WWE.

"Many have confused the issue by showing how much publicity Vince McMahon and his cronies have milked this snag for," he said. "But that doesn't take away the fact that (Nuggets owner Stan) Kroenke and the Pepsi Center are in the wrong here."
